Report: A judge or a non-judge? The manner of regulating the status of persons appointed to judicial positions with the participation of the “new” National Council of the Judiciarys
The HFHR has prepared a study on approaching the problem of judicial appointments made upon the request of the so-called new National Council of the Judiciary. The analysis includes the ECtHR ruling relating to the legal status of judges, as well as constitutional norms that must be considered when preparing statutory solutions regulating the status of these persons. The study also creates the potential framework for vetting judicial appointments made with the participation of the so-called new NCJ.
