Protection against discrimination on grounds of sexual orientation in employment and occupation

The Employment Equality Directive requires all EU Member States to provide for protection afainst discrimination on grounds of sexual orientation in employment and occupation. The present report describes the scope of protection provided by the Directive and its normative impact of the national legal systems of the Member States against the background of international and other human rights law.

The Employment Equality Directive covers not only discrimination based on the victim's actual sexual orientation but also on the basis of association and assumption. In this respect, national implementation in some EU Member States is problematic. Quite often there is no explicit law on these issues.
